1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, in general provisions, further providing for
3definitions; and, in special vehicles and pedestrians,
4providing for operation of pedalcycles with electric assist.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. The definition of "pedalcycle" in section 102 of
8Title 75 of the Pennsylvania Consolidated Statutes is amended
9and the section is amended by adding a definition to read:

10§ 102. Definitions.

11Subject to additional definitions contained in subsequent
12provisions of this title which are applicable to specific
13provisions of this title, the following words and phrases when
14used in this title shall have, unless the context clearly
15indicates otherwise, the meanings given to them in this section:

17"Pedalcycle." A vehicle propelled solely by human-powered
18pedals or a pedalcycle with electric assist. The term does not
19mean a three-wheeled human-powered pedal-driven vehicle with a

1main driving wheel 20 inches in diameter or under and primarily
2designed for children six years of age or younger.

3"Pedalcycle with electric assist". A vehicle weighing not
4more than 100 pounds with two or three wheels more than 11
5inches in diameter, manufactured or assembled with an electric
6motor system rated at not more than 750 watts and equipped with
7operable pedals and capable of a speed not more than 20 miles
8per hour on a level surface when powered by the motor source
9only. The term does not include a device specifically designed
10for use by persons with disabilities.

12Section 2. Title 75 is amended by adding a section to read:

13§ 3514. Operation of pedalcycles with electric assist.

14No person under 16 years of age may operate a pedalcycle with
15electric assist.

16Section 3. This act shall take effect in 60 days.
