AN ACT
1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, further providing for disqualification for
3commercial driver's license.
4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:
6Section 1. Section 1611(a)(5) of Title 75 of the
7Pennsylvania Consolidated Statutes is amended to read:
8§ 1611. Disqualification.
9(a) First violation of certain offenses.--Upon receipt of a
10report of conviction, the department shall, in addition to any
11other penalties imposed under this title, disqualify any person
12from driving a commercial motor vehicle or school vehicle for a
13period of one year for the first violation of:

15(5) any felony or any misdemeanor under 18 Pa.C.S. Ch.
1639 (relating to theft and related offenses) in the commission
17of which a court determines a motor vehicle was essentially
18involved and where the person was a commercial driver at the
1time the violation occurred, except as described in
2subsection (e);

4Section 2. This act shall take effect in 60 days.
