AN ACT

 

1Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2Consolidated Statutes, in forgery and fraudulent practices,
3providing for the offense of falsely impersonating recipients
4of Congressional Medal of Honor.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Title 18 of the Pennsylvania Consolidated
8Statutes is amended by adding a section to read:

9§ 4115.1. Falsely impersonating recipients of Congressional
10Medal of Honor.

11(a) Offense defined.--A person commits a summary offense if
12the person falsely represents himself verbally or in writing to
13have been awarded the Congressional Medal of Honor, as that term
14is defined in 18 U.S.C. § 704 (relating to military medals or
15decorations), and the person receives a financial benefit as a
16result of the false representation or another person reasonably
17relies on the false representation to the other person's
18financial detriment.

19(b) Nonapplicability.--Subsection (a) shall not apply to a

1representation made by a candidate for a public office during a
2political campaign for the public office.

3Section 2. This act shall take effect in 60 days.
