AN ACT

 

1Requiring insurers that approve claims for emergency services to
2directly reimburse organizations that provide such services.

3The General Assembly of the Commonwealth of Pennsylvania
4hereby enacts as follows:

5Section 1. Short title.

6This act shall be known and may be cited as the Emergency
7Service Organization Direct Reimbursement Act.

8Section 2. Definitions.

9The following words and phrases when used in this act shall
10have the meanings given to them in this section unless the
11context clearly indicates otherwise:

12"Emergency service organization." An ambulance service, 
13emergency medical service or river rescue service that is 
14located in this Commonwealth.

15"Insurer." An insurance company, association or exchange or 
16any other entity subject to the jurisdiction of the Insurance 
17Department.

1Section 3. Direct reimbursement to emergency service
2organizations.

3An insurer that approves a claim that includes the expense
4charged by an emergency service organization shall make payment
5of the claim that represents such expense directly to the
6emergency service organization, unless the person who filed the
7claim demonstrates to the insurer that he or someone on his
8behalf already paid such expense.

9Section 4. Effective date.

10This act shall take effect in 60 days.
