AN ACT

 

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, further providing for snow or ice dislodged or
3falling from moving vehicle.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 3720 of Title 75 of the Pennsylvania
7Consolidated Statutes is amended to read:

8§ 3720. Snow and ice [dislodged or falling from moving
9vehicle].

10(a) Duty to remove.--

11(1) Any driver of a motor vehicle being operated on any
12street or highway of this Commonwealth shall have an
13affirmative duty to make all reasonable efforts to remove all
14accumulated ice or snow from the motor vehicle, including the
15hood, trunk and roof of the motor vehicle.

16(2) Any driver of a motor vehicle who violates this
17subsection may be stopped on a street or highway by a law
18enforcement officer if the law enforcement officer believes

1the accumulated ice or snow may pose a threat to persons or
2property.

3(3) Any person who violates this subsection shall be
4subject to a fine of not less than $25 nor more than $75 for
5each offense regardless of whether any snow or ice is
6dislodged from the vehicle.

7(b) Dislodged or fallen snow or ice.--When snow or ice is
8dislodged or falls from a moving vehicle and strikes another
9vehicle or pedestrian causing death or serious bodily injury,
10the operator of the vehicle from which the snow or ice is
11dislodged or falls shall be subject to a fine of not less than
12$200 nor more than [$1,000] $1,500 for each offense.

13Section 2. This act shall take effect in 60 days.
