AN ACT

 

1Amending Title 61 (Prisons and Parole) of the Pennsylvania
2Consolidated Statutes, further providing for establishment.

3The General Assembly of the Commonwealth of Pennsylvania
4hereby enacts as follows:

5Section 1. Section 1731 of Title 61 of the Pennsylvania
6Consolidated Statutes is amended to read:

7§ 1731. Establishment.

8(a) General rule.--

9(1) In counties of the third, fourth and fifth class,
10the persons now holding the following offices and their
11successors in each county of the third, fourth or fifth class
12shall compose a board to be known as the board of inspectors
13of the jail or county prison.

14(2) The following persons shall be members of the board:

15(i) The president judge of the court of common pleas
16or a judge designated by him.

17(ii) [The district attorney] (Reserved).

18(iii) The sheriff.

1(iv) The controller.

2(v) The county commissioners.

3(2.1) Notwithstanding the provisions of paragraph (1),
4the district attorney in a county of the third, fourth or
5fifth class shall have the option of being a member of the
6board.

7(3) The board and the officers appointed by it shall
8provide for the safekeeping, discipline and employment of
9inmates and the government and management of the correctional
10institution.

11(4) The duty of the sheriff relating to the safekeeping
12of inmates shall cease and determine on their committal to
13the correctional institution, and the sheriff may not be
14furnished a residence in the correctional institution.

15(5) Notwithstanding the provisions of paragraph (2), the
16president judge may choose at any time to delete the judge
17position from the board by so notifying the chairperson and
18secretary of the board in writing. The decision to delete
19this position shall remain in effect for as long as the
20president judge making the decision shall remain as president
21judge and thereafter until rescinded in like fashion by a
22successor.

23(b) Counties that may elect to be subject to subchapter.--
24Any county of the sixth, seventh or eighth class may elect by
25resolution of the county commissioners to be governed by the
26provisions of this subchapter.

27Section 2. This act shall take effect in 60 days.
