AN ACT

 

1Providing for a memorandum of understanding between the
2Commonwealth and the United States Department of Justice or
3Department of Homeland Security.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Short title.

7This act shall be known and may be cited as the Security and
8Immigration Compliance Act.

9Section 2. Law enforcement.

10(a) Memorandum of understanding.--The Pennsylvania State
11Police is authorized and directed to negotiate the terms of a
12memorandum of understanding between the Commonwealth and the
13United States Department of Justice or Department of Homeland
14Security concerning the enforcement of Federal immigration and
15customs laws, detention and removals and investigations in this
16Commonwealth.

17(b) Signatures.--The memorandum of understanding shall be
18signed on behalf of the Commonwealth by the Commissioner of

1Pennsylvania State Police and the Governor or as otherwise
2required by the appropriate Federal agency.

3(c) Training.--

4(1) (i) The Pennsylvania State Police shall designate
5appropriate law enforcement officers to be trained
6pursuant to the memorandum of understanding.

7(ii) The training shall be provided only after
8receipt of adequate funding pursuant to the Consolidated
9Security, Disaster Assistance, and Continuing
10Appropriations Act, 2009 (Public Law 110-329, 122 Stat.
113574) or any subsequent source of Federal funding.

12(2) (i) In a county of the first class, the district
13attorney of the county may designate not more than four
14law enforcement officers to be trained pursuant to the
15memorandum of understanding.

16(ii) In a county of the second class, second class A
17or third class, the district attorney of the county may
18designate not more than three law enforcement officers to
19be trained pursuant to the memorandum of understanding.

20(iii) In any other county, the district attorney of
21the county may designate one law enforcement officer to
22be trained pursuant to the memorandum of understanding.

23(d) Enforcement.--A law enforcement officer certified as
24trained in accordance with the memorandum of understanding shall
25be authorized to enforce Federal immigration and customs laws
26while performing within the scope of the officer's authorized
27duties.

28Section 20. Effective date.

29This act shall take effect in 60 days.
