AN ACT

 

1Amending the act of April 9, 1929 (P.L.177, No.175), entitled
2"An act providing for and reorganizing the conduct of the
3executive and administrative work of the Commonwealth by the
4Executive Department thereof and the administrative
5departments, boards, commissions, and officers thereof,
6including the boards of trustees of State Normal Schools, or
7Teachers Colleges; abolishing, creating, reorganizing or
8authorizing the reorganization of certain administrative
9departments, boards, and commissions; defining the powers and
10duties of the Governor and other executive and administrative
11officers, and of the several administrative departments,
12boards, commissions, and officers; fixing the salaries of the
13Governor, Lieutenant Governor, and certain other executive
14and administrative officers; providing for the appointment of
15certain administrative officers, and of all deputies and
16other assistants and employes in certain departments, boards,
17and commissions; and prescribing the manner in which the
18number and compensation of the deputies and all other
19assistants and employes of certain departments, boards and
20commissions shall be determined," further providing for
21Pennsylvania State Police.

22The General Assembly of the Commonwealth of Pennsylvania
23hereby enacts as follows:

24Section 1. Section 205(b) of the act of April 9, 1929
25(P.L.177, No.175), known as The Administrative Code of 1929,
26amended July 11, 1991 (P.L.73, No.12) and repealed in part
27December 13, 2001 (P.L.903, No.100), is amended and the section

1is amended by adding subsections to read:

2Section 205. Pennsylvania State Police.--* * *

3(b) [The State Police Force shall consist of such number of
4officers and men, and shall be organized in such manner, as the
5Commissioner of Pennsylvania State Police, with the approval of
6the Governor, shall from time to time determine: Provided,
7however, That the] The number of [officers and men] Pennsylvania 
8State Police shall not exceed in the aggregate at any time
9[three thousand nine hundred and forty persons. State policemen,
10both officers and men,] four thousand three hundred ten persons, 
11provided that Pennsylvania State Police members assigned to duty
12with the Pennsylvania Turnpike Commission, the Pennsylvania 
13Gaming Control Board, the Pennsylvania Liquor Control Board, the 
14Delaware River Joint Toll Bridge Commission or [assigned to
15duty] as resident State troopers, shall [not be counted in
16determining the total number of officers and men in the State
17Police Force] be excluded in determining such number.

18(b.1) On January 1 of each year, if the difference between
19the aggregate number of State Police members is less than the
20amount authorized in subsection (b) by five per centum or
21greater, the Governor shall require the commissioner to
22authorize a new cadet class for the next fiscal year to ensure
23public safety.

24(b.2) If a cadet class is authorized under subsection (b.1)
25it shall be open to no fewer than one hundred fifty individuals.

27Section 2. This act shall take effect in 60 days.
