AN ACT
1Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2act relating to the public school system, including certain
3provisions applicable as well to private and parochial
4schools; amending, revising, consolidating and changing the
5laws relating thereto," in school health services, further
6providing for employment of school health personnel.
7The General Assembly of the Commonwealth of Pennsylvania
8hereby enacts as follows:
9Section 1. Section 1410 of the act of March 10, 1949
10(P.L.30, No.14), known as the Public School Code of 1949, added
11July 15, 1957 (P.L.937, No.404), is amended to read:
12Section 1410. Employment of School Health Personnel.--(a)
13Except as otherwise provided in this article, all school
14districts alone or jointly with other districts or joint school
15boards shall employ school physicians and school dentists but
16only with the approval of the Secretary of Health, and shall
17compensate them on a basis agreed upon by the school physician
18or school dentist and the employing district or joint school
19board, and shall employ one or more school nurses. Health
1officers of municipalities may be appointed as school physicians
2by school districts or joint school boards. For special
3examinations recommended by school physicians, school districts
4or joint school boards may engage the services of
5[ophthamologists] ophthalmologists or other licensed medical
6specialists or of optometrists. Any school district alone or
7jointly with other districts or joint school boards may employ
8dental hygienists and such other technical and clerical
9personnel as are necessary to carry out the provisions of this
10article.
11(b) A school nurse who is not CPR-certified by a Department
12of Health-approved certifying agency by July 1, 2013, shall
13complete CPR training within one year. A person hired for a
14position as a school nurse after July 1, 2013, shall be CPR-
15certified or complete CPR certification through a Department of
16Health-approved certifying agency within one year of the hire
17date. A school nurse shall complete CPR recertification within
18the time frame established by the approved certifying agency.
19Section 2. This act shall take effect immediately.
