AN ACT

 

1Amending the act of April 9, 1929 (P.L.177, No.175), entitled
2"An act providing for and reorganizing the conduct of the
3executive and administrative work of the Commonwealth by the
4Executive Department thereof and the administrative
5departments, boards, commissions, and officers thereof,
6including the boards of trustees of State Normal Schools, or
7Teachers Colleges; abolishing, creating, reorganizing or
8authorizing the reorganization of certain administrative
9departments, boards, and commissions; defining the powers and
10duties of the Governor and other executive and administrative
11officers, and of the several administrative departments,
12boards, commissions, and officers; fixing the salaries of the
13Governor, Lieutenant Governor, and certain other executive
14and administrative officers; providing for the appointment of
15certain administrative officers, and of all deputies and
16other assistants and employes in certain departments, boards,
17and commissions; and prescribing the manner in which the
18number and compensation of the deputies and all other
19assistants and employes of certain departments, boards and
20commissions shall be determined," in administrative
21organization, further providing for advisory boards and
22commissions; and, in powers and duties of Department of
23Health and its departmental administrative and advisory
24boards, establishing the Advisory Board on Acquired Brain
25Injury.

26The General Assembly of the Commonwealth of Pennsylvania
27hereby enacts as follows:

28Section 1.  Section 203 of the act of April 9, 1929 (P.L.177,
29No.175), known as The Administrative Code of 1929, amended July

19, 2010 (P.L.348, No.50), is amended to read:

2Section 203.  Advisory Boards and Commissions.--The following
3advisory boards and commissions are placed in and made parts of
4the respective administrative departments, as follows:

5In the Department of Military and Veterans Affairs,

6State Military Reservation Commission,

7In the Department of Environmental Protection,

8Citizens Advisory Council;

9In the Department of Health,

10Advisory Health Board[;],

11Advisory Board on Acquired Brain Injury;

12In the Department of Labor and Industry,

13Advisory Council on Affairs of the Handicapped,

14Advisory Board on Problems of Older Workers,

15Policy, Planning and Evaluation Advisory Committee;

16In the Department of Public Welfare,

17State Board of Public Welfare,

18Advisory Committee for the Blind,

19Advisory Committee for General and Special Hospitals,

20Advisory Committee for Children and Youth,

21Advisory Committee for Public Assistance,

22Advisory Committee for Mental Health and Mental

23Retardation.

24Section 2.  The act is amended by adding a section to read:

25Section 2126.  Advisory Board on Acquired Brian Injury.--(a) 
26The Advisory Board on Acquired Brain Injury is established
27within the Department of Health.

28(b)  The advisory board shall consist of twenty-five members
29who shall be appointed by the Secretary of Health. The
30membership of the advisory board shall include:

1(1)  Family members of acquired brain injury survivors.

2(2)  Individuals living with an acquired brain injury.

3(3)  Representatives from the Department of Aging, Department
4of Public Welfare, Department of Labor and Industry, Insurance
5Department, Department of Health, Department of Corrections and
6Department of Education.

7(4)  Representatives from a Statewide association that
8promotes the rights of persons with disabilities, a Statewide
9association that represents rehabilitation facilities, a
10Statewide association that represents persons with acquired
11brain injuries.

12(5)  Community-based organizations that provide acquired
13brain injury services or advocacy.

14(c)  The term of office of each member of the advisory board
15shall be three years from the third Tuesday of January of the
16year in which the member takes office or until the member's
17successor has been appointed.

18(d)  Vacancies in the membership of the advisory board shall
19be filled for the balance of an unexpired term in the same
20manner as the original appointment.

21(e)  Members of the advisory board shall serve without
22compensation but shall be entitled to reimbursement for travel
23and other actual expenses incurred in the performance of their
24duties.

25(f)  A chairperson, vice chairperson and secretary of the
26advisory board shall be elected by the members of the board. The
27advisory board shall meet at least four times a year at such
28times and places as it shall determine.

29(g)  Notwithstanding any provision of this section, a member
30who serves on the effective date of this section may complete

1the member's term.

2(h)  The advisory board shall have the power, and its duty
3shall be:

4(1)  To advise the Governor and the departments represented
5on the advisory board in the determination of service and
6support needs of individuals with an acquired brain injury and
7the implementation of services to those individuals and their
8families.

9(2)  To make recommendations regarding future activities to
10be placed in the acquired brain injury State Action Plan with
11the goal of improving access to services in this Commonwealth
12through information and education.

13Section 2.  This act shall take effect in 60 days.
