AN ACT
1Amending <-Title Titles 30 (Fish) and 34 (Game) of the
2Pennsylvania Consolidated Statutes, in enforcement, further
3providing for powers and duties of <-waterways conservation
4officers and deputies and for powers and duties of
5enforcement officers.
6The General Assembly of the Commonwealth of Pennsylvania
7hereby enacts as follows:
<-8Section 1. Section 901 of Title 34 of the Pennsylvania
9Consolidated Statutes is amended by adding a subsection to read:

11Consolidated Statutes is amended by adding a subsection to read:
12§ 901. Powers and duties of waterways conservation officers and
13deputies.

15(c) Exception to the prohibition of interception and
16disclosure of communications.--A waterways conservation officer
17whose duty it is to enforce this title shall be defined as a law
18enforcement officer for the purpose of 18 Pa.C.S. § 5704(16)
19(iii) (relating to exceptions to prohibition of interception and
1disclosure of communications). This subsection shall not apply
2to a deputy waterways conservation officer.
3Section 2. Section 901 of Title 34 is amended by adding a
4subsection to read:
5§ 901. Powers and duties of enforcement officers.

7(b.1) Exception to the prohibition of interception and
8disclosure of communications.--An officer whose duty it is to
9enforce this title shall be defined as a law enforcement officer
10for the purpose of 18 Pa.C.S. § 5704(16)(iii) (relating to
11exceptions to the<- prohibition of interception and disclosure of
12communications). <-This subsection shall not apply to a deputy
13Game Commission officer or deputy wildlife conservation officer.

15Section <-2 3. This act shall take effect in 60 days.
