1Amending Title 65 (Public Officers) of the Pennsylvania
2Consolidated Statutes, further providing for restricted 
3activities and for penalties.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 1103 of Title 65 of the Pennsylvania
7Consolidated Statutes is amended by adding a subsection to read:

8§ 1103. Restricted activities.

10(c.1) Accepting cash gift.--No public official, public
11employee or nominee or candidate for public office shall solicit
12or accept a gift of cash. This paragraph shall not apply to a
13gift received from a spouse, parent, parent by marriage,
14sibling, child, grandchild, other family member or friend when
15the circumstances are clear that the motivation for the action

1was a personal or family relationship. However, for the purposes
2of this paragraph, the term "friend" may not include a
3registered lobbyist or an employee of a registered lobbyist.

5Section 2. Section 1109(a) of Title 65 is amended to read:

6§ 1109. Penalties.

7(a) Restricted activities violation.--Any person who
8violates the provisions of section 1103(a), (b) [and (c)], (c) 
9and (c.1) (relating to restricted activities) commits a felony
10and shall, upon conviction, be sentenced to pay a fine of not
11more than $10,000 or to imprisonment for not more than five
12years, or both.

14Section 3. This act shall take effect in 60 days.
