AN ACT

 

1Providing for a nonbinding Statewide referendum relating to
2legalizing marijuana.

3The General Assembly of the Commonwealth of Pennsylvania
4hereby enacts as follows:

5Section 1. Legislative findings.

6The General Assembly finds that the electors of this
7Commonwealth should be given the opportunity to voice their
8opinion if they wish to legalize marijuana. The power of the
9government rests within the people as stated in section 2 of
10Article I of the Constitution of Pennsylvania:

11"All power is inherent in the people, and all free
12governments are founded on their authority and instituted
13for their peace, safety and happiness. For the
14advancement of these ends they have at all times an
15inalienable and indefeasible right to alter, reform or
16abolish their government in such manner as they may think
17proper."

18Section 2. Authorization.

1The Secretary of the Commonwealth shall cause to be placed on
2the ballot, at the primary or general election occurring at
3least 30 days next following the effective date of this section,
4a nonbinding referendum to determine the will of the electorate
5of this Commonwealth with respect to legalizing marijuana.

6Section 3. Form of question.

7The referendum question shall be in substantially the
8following form:

9Shall the Pennsylvania General Assembly legalize
10marijuana?

11Section 4. Conduct of election.

12The referendum shall be advertised and conducted in 
13accordance with the provisions of the act of June 3, 1937 
14(P.L.1333, No.320), known as the Pennsylvania Election Code.

15Section 5. Effective date.

16This act shall take effect immediately.
