AN ACT

 

1Amending the act of July 23, 1970 (P.L.563, No.195), entitled
2"An act establishing rights in public employes to organize
3and bargain collectively through selected representatives;
4defining public employes to include employes of nonprofit
5organizations and institutions; providing compulsory
6mediation and fact-finding, for collective bargaining
7impasses; providing arbitration for certain public employes
8for collective bargaining impasses; defining the scope of
9collective bargaining; establishing unfair employe and
10employer practices; prohibiting strikes for certain public
11employes; permitting strikes under limited conditions;
12providing penalties for violations; and establishing
13procedures for implementation," barring strikes by employees
14of the Southeastern Pennsylvania Transportation Authority.

15The General Assembly of the Commonwealth of Pennsylvania
16hereby enacts as follows:

17Section 1. Section 1001 of the act of July 23, 1970
18(P.L.563, No.195), known as the Public Employe Relations Act, is
19amended to read:

20Section 1001. Strikes by employes of the Southeastern 
21Pennsylvania Transportation Authority (SEPTA), guards at prisons
22or mental hospitals, or employes directly involved with and
23necessary to the functioning of the courts of this Commonwealth
24are prohibited at any time. If a strike occurs the public

1employer shall forthwith initiate in the court of common pleas
2of the jurisdiction where the strike occurs, an action for
3appropriate equitable relief including but not limited to
4injunctions. If the strike involves Commonwealth employes, the
5chief legal officer of the public employer or the Attorney
6General where required by law shall institute an action for
7equitable relief, either in the court of common pleas of the
8jurisdiction where the strike has occurred or the Commonwealth
9Court.

10Section 2. This act shall take effect immediately.
