AN ACT

 

1Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
2act to consolidate, editorially revise, and codify the public
3welfare laws of the Commonwealth," in public assistance,
4prohibiting eligibility for Megan's Law violators.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. The act of June 13, 1967 (P.L.31, No.21), known
8as the Public Welfare Code, is amended by adding a section to
9read:

<-10Section 432.25. Eligibility for Megan's Law Violators.--
11Persons convicted of any offense pursuant to 42 Pa.C.S. Ch. 97
12Subch. H (relating to registration of sexual offenders) who have
13not otherwise satisfied the penalty imposed upon them by law and
14who are not in compliance with the requirements within this

1article shall not be eligible for assistance.

<-2Section 432.25. Eligibility for Megan's Law Violators.--An
3individual required to register as a convicted sexual offender
4pursuant to 42 Pa.C.S. § 9799.13 (relating to applicability) who
5is not compliant with the registration requirements imposed upon
6them by 42 Pa.C.S. §§ 9799.15 (relating to period of
7registration), 9799.19 (relating to initial registration) and
89799.25 (relating to verification by sexual offenders and
9Pennsylvania State Police) shall not be eligible for assistance
10until the individual can prove compliance with the applicable
11registration requirements. The eligibility for assistance of
12minor children living in the household shall not be affected by
13an individual being deemed ineligible for assistance by this
14section.

15Section 2. This act shall take effect in 60 days.
