AN ACT

 

1Amending Title 23 (Domestic Relations) of the Pennsylvania
2Consolidated Statutes, in marriage, repealing provisions
3relating to waiting period after application; and further
4providing for issuance of license.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Section 1303 of Title 23 of the Pennsylvania
8Consolidated Statutes is repealed:

9[§ 1303. Waiting period after application.

10(a) General rule.--No marriage license shall be issued prior
11to the third day following the making of application therefor.

12(b) Exceptions.--The court may authorize a license to be
13issued at any time after the making of the application in the
14following cases:

15(1) In case of emergency or extraordinary circumstances.

16(2) If an applicant is a member of the Pennsylvania
17National Guard or other reserve component of the armed forces
18of the United States and is called or ordered to active duty

1with the armed forces of the United States.]

2Section 2. Section 1307 of Title 23 is amended to read:

3§ 1307. Issuance of license.

4The marriage license shall be issued immediately following 
5the making of application therefor if it appears from properly
6completed applications on behalf of each of the parties to the
7proposed marriage that there is no legal objection to the
8marriage. [Except as provided by section 1303(b) (relating to
9waiting period after application), the license shall not be
10issued prior to the third day following the date of the most
11recent of the two applications therefor.]

12Section 3. This act shall take effect in 60 days.
