AN ACT

 

1Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2act relating to the public school system, including certain
3provisions applicable as well to private and parochial
4schools; amending, revising, consolidating and changing the
5laws relating thereto," in grounds and buildings, further
6providing for acquisition of buildings, sites for school
7buildings and playgrounds and disposing thereof.

8The General Assembly of the Commonwealth of Pennsylvania
9hereby enacts as follows:

10Section 1. Section 703 of the act of March 10, 1949 (P.L.30,
11No.14), known as the Public School Code of 1949, amended June 
1230, 2011 (P.L.112, No.24), is amended to read:

13Section 703. Acquisition of Buildings, Sites for School
14Buildings and Playgrounds, and Disposing Thereof.--(a) In order
15to comply with the provisions of this act, and subject to the
16conditions thereof, the board of school directors of each
17district is hereby vested with the necessary power and authority
18to acquire, in the name of the district, by purchase, lease,

1gift, devise, agreement, condemnation, or otherwise, any and all
2schools and real estate, either vacant or occupied, including
3lands theretofore occupied by streets and alleys which have been
4vacated by municipal authorities, and to acquire by purchase,
5lease, gift or devise, other buildings approved for school use
6by the Department of Education as the board of school directors
7may deem necessary to furnish school buildings or other suitable
8sites for proper school purposes for said district or to enlarge
9the grounds of any school property held by such district, and to
10sell, convey, transfer, dispose of, or abandon the same, or any
11part thereof, as the board of school directors may determine.
12Approval of the Department of Education shall not be required
13for school buildings and playgrounds on any school construction
14project for which State reimbursement is not requested.

15(b) Notwithstanding the provisions of this act or any other
16provisions of law to the contrary:

17(1) Where a school district does not request State
18reimbursement for a school construction project, the school
19district shall not be required to comply with the provisions of
20the act of August 15, 1961 (P.L.987, No.442), known as the
21"Pennsylvania Prevailing Wage Act."

22(2) Where a board of school directors elects not to comply
23with the provisions of the Pennsylvania Prevailing Wage Act
24under this subsection, the board of school directors shall
25provide the Department of Education with notice in a form
26prescribed by the Department of Education.

27(3) The Department of Education may not impose any
28requirements on a board of school directors under this
29subsection other than prescribing the form in which the notice
30shall be provided.

1Section 2. This act shall take effect in 60 days.
