AN ACT

 

1Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2Consolidated Statutes, <-in riot, disorderly conduct and 
3related offenses, further providing for the offense of
4cruelty to animals.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Section 5511 of Title 18 of the Pennsylvania
8Consolidated Statutes is amended by adding a subsection to read:

9§ 5511. Cruelty to animals.

11(c.1) Prohibition of activities related to dogs and cats.--

12(1) A person commits an offense if the person does any
13of the following:

14(i) Kills a dog or cat, regardless of ownership of
15the animal, for the purpose of human consumption.

1(ii) Processes dog or cat meat for the purpose of
2human consumption.

3(iii) Breeds, keeps, sells, offers for sale or
4transfers a dog or cat for the purpose of human
5consumption.

6(iv) Offers dog or cat meat for human consumption.

7(2) Except as set forth in paragraph (3), a person <-that
<-8who violates this subsection commits a misdemeanor of the
9first degree and shall, upon conviction, be sentenced to pay
10a fine of not less than $1,000 nor more than $10,000 or to
11imprisonment for not more than five years, or both.

12(3) A person who<-, after being sentenced under paragraph
13(2), violates this subsection <-and who has committed a prior
14offense commits a felony of the third degree and shall, upon
15conviction, be sentenced to pay a fine of not less than
16$2,500 nor more than $15,000 or to imprisonment for not more
17than seven years, or both. <-As used in this paragraph, the
18term "prior offense" shall mean a conviction, adjudication of
19delinquency, acceptance of Accelerated Rehabilitative
20Disposition or other form of preliminary disposition,
21occurring before the sentencing on the present violation, for
22any of the following:

23(i) an offense under this subsection; or

24(ii) an offense substantially similar to an offense
25under this subsection, including an offense under a prior
26law of this Commonwealth or an offense under a law of
27another jurisdiction.

29Section 2. This act shall take effect in 60 days.
