1Requiring mobile applications to disclose certain information
2about data collection.

3The General Assembly of the Commonwealth of Pennsylvania
4hereby enacts as follows:

5Section 1. Short title.

6This act shall be known and may be cited as the Mobile
7Application Consumer Protection Act.

8Section 2. Definitions.

9The following words and phrases when used in this act shall
10have the meanings given to them in this section unless the
11context clearly indicates otherwise:

12"Mobile application." An application or program that can be
13downloaded or installed onto a portable electronic device.

14Section 3. Requirements.

15(a) Notification.--Before downloading any mobile
16applications, consumers shall be given a notification of the
17types of data that will be collected or accessed by the

1application. The notification shall appear to the consumer prior
2to any download or installation and before any data has been
3collected.

4(b) Format of notification.--The notification shall be in
5plain language, easily visible and in a style and font that is
6legible to consumers.

7Section 4. Penalty.

8A developer, organization or individual who violates the
9provisions of this act shall, upon conviction, be fined $25 per
10instance.

11Section 5. This act shall take effect in 60 days.
