AN ACT

 

1Repealing the act of December 18, 1984 (P.L.1068, No.213),
2entitled "An act requiring physicians to obtain informed
3consent from patients for treatment of breast disease."

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. The act of December 18, 1984 (P.L.1068, No.213),
7entitled "An act requiring physicians to obtain informed consent
8from patients for treatment of breast disease," amended October
99, 1986 (P.L.1417, No.131), is repealed:

11Requiring physicians to obtain informed consent from patients
12for treatment of breast disease.

13The General Assembly of the Commonwealth of Pennsylvania
14hereby enacts as follows:

15Section 1. Before a physician operates on a patient for a

1tumor of the breast, a consent form shall have been executed
2which includes the following:

3"CONSENT FOR TREATMENT OF BREAST DISEASE"

4Sign option (a) or option (b), or option (a) and option (b).

6Side (right or left)

8Patient's Signature

9(b) If it is determined that I have a malignant tumor in my
10breast or other breast abnormality requiring surgery, then I
11authorize Dr. ........... to perform such operations or
12procedures, including breast removal, which are deemed
13necessary. I have been informed of the current medically
14accepted alternatives to radical mastectomy.

19Section 2. In addition to civil proceedings, failure to
20comply with the provisions of this act shall subject the
21physician to disciplinary action under the act of July 20, 1974 
22(P.L.551, No.190), known as the Medical Practice Act of 1974, or
23under the act of October 5, 1978 (P.L.1109, No.261), known as
24the Osteopathic Medical Practice Act.

25Section 3. This act shall take effect in 60 days.]
