AN ACT

 

1Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2Consolidated Statutes, in firearms and other dangerous
3articles, providing for report of theft or loss of firearm.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Title 18 of the Pennsylvania Consolidated
7Statutes is amended by adding a section to read:

8§ 6115.1. Report of theft or loss of firearm.

9(a) Duty to report.--An owner or other person lawfully in
10possession of a firearm who suffers the loss or theft of a
11firearm shall, within 72 hours of the discovery of the loss or
12theft, report the facts and circumstances of the loss or theft
13to the municipal police of the jurisdiction in which the loss or
14theft is believed to have occurred or the Pennsylvania State
15Police. The person making the report shall provide all known
16information about the firearm, including, but not limited to,
17the following:

1(1) Name and address of the owner.

2(2) All known facts and circumstances pertaining to the
3loss or theft.

4(3) Name of the manufacturer and importer.

5(4) Model.

6(5) Type of action.

7(6) Caliber or gauge.

8(7) Serial number.

9(8) Any other information deemed necessary by the
10officer or police department receiving the report.

11(b) Sharing of information.---A law enforcement agency that
12receives a report pursuant to this section shall, within 24
13hours of receiving the report, forward notice of the loss or
14theft as well as all information obtained under subsection (a)
15to the Pennsylvania State Police.

16(c) Pennsylvania State Police.--The Pennsylvania State
17Police shall receive, collect and file the information forwarded
18to it under subsection (b). The Pennsylvania State Police shall
19cooperate and undertake to furnish or make the information
20available to all law enforcement agencies in this Commonwealth
21for the purpose of coordinating law enforcement efforts to
22locate the firearm.

23(d) Penalty.—-Notwithstanding any other provision of law, a
24person who violates subsection (a) commits:

25(1) A summary offense for the first offense, punishable
26by a fine not to exceed $500.

27(2) A misdemeanor of the second degree for a second
28offense.

29(3) A misdemeanor of the first degree for a third or
30subsequent offense.

1Section 2. This act shall take effect in 60 days.
