AN ACT

 

1Establishing the Donated Dental Services Program; imposing
2duties on the Department of Health; providing for program
3administration and for contract requirements; and making an
4appropriation.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Short title.

8This act shall be known and may be cited as the Donated
9Dental Services Act.

10Section 2. Definitions.

11The following words and phrases when used in this act shall
12have the meanings given to them in this section unless the
13context clearly indicates otherwise:

14"Department." The Department of Health of the Commonwealth.

15"Program." The Donated Dental Services Program established
16in section 3.

17Section 3. Establishment of program.

1The Donated Dental Services Program is established.

2Section 4. Maintenance of program.

3The department, in consultation with the Dental Lifeline
4Network or its designee, shall maintain the program through
5which volunteer dentists provide comprehensive dental care for
6needy, disabled, aged and medically compromised individuals who
7cannot afford necessary treatment but are ineligible for public
8assistance. Eligible individuals may be treated by the volunteer
9dentists in their private offices or other appropriate
10locations. Eligible individuals may not be required to pay a fee
11or cost.

12Section 5. Program administration.

13To administer the program, the department shall contract with
14the Dental Lifeline Network or its designee who must be
15experienced in providing similar services or programs.

16Section 6. Contract requirements.

17The contract shall specify the responsibilities of the
18administering organization that may include:

19(1) The maintenance of a network of volunteer dentists,
20including dental specialists, volunteer dental laboratories
21and other appropriate volunteer professionals, to donate
22dental services to eligible individuals.

23(2) The maintenance of a system to refer eligible
24individuals to appropriate volunteers.

25(3) The continuance and implementation of a public
26awareness campaign to educate eligible individuals about the
27availability of the program.

28(4) Providing appropriate administrative and technical
29support to the program.

30(5) Submitting an annual report to the department that:

1(i) Accounts for program funds.

2(ii) Reports the number of individuals served by the
3program and the number of dentists and dental
4laboratories participating as providers in the program.

5(iii) Other information required by the department.

6(6) Performing, as required by the department, another
7duty relating to the program.

8Section 19. Appropriation.

9The sum of $150,000, or as much thereof as may be necessary,
10is appropriated to the department for the fiscal year July 1,
112013, to June 30, 2014, to carry out the provisions of this act.

12Section 20. Effective date.

13This act shall take effect immediately.
