AN ACT

 

1Amending Titles 4 (Amusements) and 18 (Crimes and Offenses) of
2the Pennsylvania Consolidated Statutes, further providing for
3general and specific powers and for gambling devices,
4gambling, etc.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Section 1202(a) of Title 4 of the Pennsylvania
8Consolidated Statutes is amended by adding a paragraph to read:

9§ 1202. General and specific powers.

12(7) The board shall not promulgate rules and regulations
13allowing any form of Internet gambling.

15Section 2. Section 5513(e) of Title 18 is amended and the
16section is amended by adding a subsection to read:

17§ 5513. Gambling devices, gambling, etc.

1(d.1) Internet gambling.--No individual or entity shall
2solicit, invite, collect or accept cash or any other form of
3currency through the Internet for the purposes of wagering or
4betting. No individual or entity shall organize, or cause to be
5organized, any type of gambling event that is held over the
6Internet.

7(e) Penalty.--

8(1) Any person who fails to provide records as provided
9in subsection (d) commits a summary offense.

10(2) A first offense under subsection (d.1) shall be
11considered a first offense punishable by a fine of not more
12than $300.

13(3) A second offense under subsection (d.1) shall be
14considered a summary offense punishable by a fine of not more
15than $600 and a term of imprisonment not to exceed three
16days.

17(4) A third or subsequent offense under subsection (d.1)
18shall be considered a third degree misdemeanor.

20Section 3. This act shall apply to bets and wagers placed on
21or after the effective date of this section.

22Section 4. This act shall take effect in 60 days.
