AN ACT

 

1Amending the act of May 17, 1921 (P.L.682, No.284), entitled "An
2act relating to insurance; amending, revising, and
3consolidating the law providing for the incorporation of
4insurance companies, and the regulation, supervision, and
5protection of home and foreign insurance companies, Lloyds
6associations, reciprocal and inter-insurance exchanges, and
7fire insurance rating bureaus, and the regulation and
8supervision of insurance carried by such companies,
9associations, and exchanges, including insurance carried by
10the State Workmen's Insurance Fund; providing penalties; and
11repealing existing laws," further providing for health
12insurance coverage for certain children of insured parents.

13The General Assembly of the Commonwealth of Pennsylvania
14hereby enacts as follows:

15Section 1. Section 617.1(A) of the act of May 17, 1921
16(P.L.682, No.284), known as The Insurance Company Law of 1921,
17added June 10, 2009 (P.L.42, No.4), is amended to read:

18Section 617.1. Health Insurance Coverage for Certain 
19Children of Insured Parents.--(A) An insurer that issues, 
20delivers, executes or renews group health care insurance in this 
21Commonwealth, under which coverage of a child would otherwise 
22terminate at a specified age, shall, at the option of the
 

1[policyholder] policyholder's insured employe, provide coverage 
2to a child of an insured employe beyond that specified age, up 
3through and including the age of 29, at the insured employe's 
4expense, and provided that the child meet all of the following 
5requirements:

6(1) Is not married.

7(2) Has no dependents.

8(3) Is a resident of this Commonwealth or is enrolled as a
9full-time student at an institution of higher education.

10(4) Is not provided coverage as a named subscriber, insured, 
11enrollee or covered person under any other group or individual 
12health insurance policy or enrolled in or entitled to benefits 
13under any government health care benefits program, including 
14benefits under Title XVIII of the Social Security Act (49 Stat. 
15620, 42 U.S.C. § 1395 et seq.).

17Section 2. The amendment of section 617.1 of the act shall
18apply to either of the following that occurs 60 days after the
19effective date of this act:

20(1) entering into a contract; or

21(2) renewing a contract.

22Section 3. This act shall take effect in 60 days.
