AN ACT

 

1Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2Consolidated Statutes, in firearms and other dangerous
3articles, further providing for licenses.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 6109(i) of Title 18 of the Pennsylvania
7Consolidated Statutes is amended to read:

8§ 6109. Licenses.

10(i) Revocation.--[A license to carry firearms may be revoked
11by the issuing authority for good cause. A]

12(1) Except as provided under paragraph (2), a license to
13carry firearms shall be revoked by the issuing authority for
14any reason stated in subsection (e)(1) which occurs during
15the term of the permit. Notice of revocation shall be in
16writing and shall state the specific reason for revocation.

1Notice shall be sent by certified mail to the individual
2whose license is revoked, and, at that time, notice shall
3also be provided to the Pennsylvania State Police by
4electronic means, including e-mail or facsimile transmission,
5that the license is no longer valid. An individual whose
6license is revoked shall surrender the license to the issuing
7authority within five days of receipt of the notice. An
8individual whose license is revoked may appeal to the court
9of common pleas for the judicial district in which the
10individual resides. An individual who violates this section
11commits a summary offense.

12(2) If a revocation of a license to carry firearms is
13based on subsection (e)(1)(i) or for good cause not otherwise
14specifically enumerated under subsection (e)(1), the issuing
15authority shall provide the licensee notice via certified
16mail of intent to revoke the license. The licensee shall have
17a right to an evidentiary hearing before the court of common
18pleas for the judicial district in which the individual
19resides prior to the revocation. If the licensee fails to
20respond to a notice of intention to revoke within 30 days,
21the issuing authority may revoke the license and the
22individual shall be deemed to have waived the right to appeal
23the revocation.
