AN ACT

 

1Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2act relating to the public school system, including certain
3provisions applicable as well to private and parochial
4schools; amending, revising, consolidating and changing the
5laws relating thereto," providing for evaluation of
6educators; and further providing for applicability.

7The General Assembly of the Commonwealth of Pennsylvania
8hereby enacts as follows:

9Section 1. The act of March 10, 1949 (P.L.30, No.14), known
10as the Public School Code of 1949, is amended by adding a
11section to read:

12Section 1729.1-A. Evaluation of Educators.--(a) All
13applications by a charter school entity for a charter or for the
14renewal of a charter shall include a system of evaluation for
15educators that includes both of the following:

16(1) At least four (4) rating categories of educator
17performance.

18(2) Multiple measures of student performance which shall
19include, but may not be limited to, value-added assessment

1system data made available by the department under section 221
2and student performance on the most recent assessments for which
3results have been released by the department and may include
4goals specific to the mission of the charter school entity's
5charter.

6(b) Nothing in this section shall preempt the powers of a
7board of trustees under section 1716-A(a) nor affect the intent
8of the General Assembly provided in section 1702-A(3) and (4).

9(c) For purposes of this section:

10(1) The term "assessment" shall mean the Pennsylvania System
11of School Assessment test, the Keystone Exam, an equivalent
12local assessment or another test established by the State board
13to meet the requirements of section 2603-B(d)(10)(i) and
14required under the No Child Left Behind Act of 2001 (Public Law
15107-110, 115 Stat. 1425) or its successor statute or required to
16achieve other standards established by the department for the
17school or school district under 22 Pa. Code § 403.3 (relating to
18single accountability system).

19(2) The term "charter school entity" shall mean a charter
20school, cyber charter school or regional charter school.

21Section 2. Section 1749-A(a)(1) of the act, added June 29,
222002 (P.L.524, No.88), is amended to read:

23Section 1749-A. Applicability of other provisions of this act
24and of other acts and regulations.

25(a) General requirements.--Cyber charter schools shall be
26subject to the following:

27(1) Sections 108, 110, 111, 321, 325, 326, 327, 431,
28436, 443, 510, 518, 527, 708, 752, 753, 755, 771, 776, 777,
29808, 809, 810, 1109, 1111, 1112(a), 1205.1, 1205.2, 1301,
301302, 1310, 1317.2, 1318, 1330, 1332, 1303-A, 1518, 1521,

11523, 1531, 1547, 1702-A, 1703-A, 1714-A, 1715-A, 1716-A,
21719-A, 1721-A, 1722-A, 1723-A(a) and (b), 1724-A, 1725-A,
31727-A, 1729-A, 1729.1-A, 1730-A, 1731-A(a)(1) and (b) and
42014-A and Articles XII-A, XIII-A and XIV.

6Section 3. This act shall take effect in 60 days.
