1 Amending the act of May 11, 1889 (P.L.188, No.210), entitled "A
2 further supplement to an act, entitled 'An act to establish a
3 board of wardens for the Port of Philadelphia, and for the
4 regulation of pilots and pilotage, and for other purposes,'
5 approved March twenty-ninth, one thousand eight hundred and
6 three, and for regulating the rates of pilotage and number of
7 pilots," further providing for certain charges.

8 The General Assembly of the Commonwealth of Pennsylvania
9 hereby enacts as follows:

10 Section 1. Sections 3.1(b) and (c), 3.2(b) and (c) and 3.3
11 of the act of May 11, 1889 (P.L.188, No.210), entitled "A
12 further supplement to an act, entitled 'An act to establish a
13 board of wardens for the Port of Philadelphia, and for the
14 regulation of pilots and pilotage, and for other purposes,'
15 approved March twenty-ninth, one thousand eight hundred and
16 three, and for regulating the rates of pilotage and number of
17 pilots," amended October 7, 2010 (P.L.502, No.71), are amended
18 to read:

19 Section 3.1. For services rendered on and after January 1,
20 1990, retroactively, the rates of pilotage for conducting a

1 vessel from the Capes of the Delaware to a place on the Delaware
2 River or Bay no further upriver than the Delair Railroad Bridge
3 between Philadelphia, Pennsylvania, and Delair, New Jersey, or
4 from a place on the river Delaware no further upriver than the
5 Delair Railroad Bridge between Philadelphia, Pennsylvania, and
6 Delair, New Jersey, to the Capes of the Delaware, in either
7 case, shall be computed as follows:

9 (b) The charges per unit shall be as follows:

10 [(i) Effective January 1, 2010	$12.36 per unit
11 (ii) Effective January 1, 2011	$12.36 per unit
12 (iii) Effective January 1, 2012	$12.61 per unit
13 (iv) Effective January 1, 2013	$12.86 per unit]

14 (i) Effective January 1, 2013	$12.86 per unit
15 (ii) Effective January 1, 2014	$13.25 per unit
16 (iii) Effective January 1, 2015	$13.64 per unit
17 (iv) Effective January 1, 2016	$14.05 per unit

18 (c) There shall be a minimum charge of two hundred units and
19 a maximum unit charge as follows:

20 [(i) Effective January 1, 2010	1,400 units
21 (ii) Effective January 1, 2011	1,400 units
22 (iii) Effective January 1, 2012	1,400 units
23 (iv) Effective January 1, 2013	1,400 units]

24 (i) Effective January 1, 2013	1,400 units
25 (ii) Effective January 1, 2014	1,400 units
26 (iii) Effective January 1, 2015	1,400 units
27 (iv) Effective January 1, 2016	1,400 units

28 Section 3.2. That every ship or vessel bound to the Delaware
29 breakwater for orders shall be obliged to receive a pilot,
30 provided she is spoken or a pilot offers his services, outside

1 of a straight line drawn from Cape Henlopen Light to Cape May
2 Light, and every ship or vessel bound to the breakwater for
3 orders shall pay pilotage fees as follows: A sum equal to half
4 the pilotage to the Port of Philadelphia, and she shall be
5 obliged to take a pilot and pay the same pilotage fees when
6 outward bound, from the breakwater, and if such ship or vessel,
7 without discharging her pilot, proceed to the Port of
8 Philadelphia or any other port or place on the bay or river
9 Delaware, only one full pilotage fee as fixed by section 3.1 of
10 this act, for the entire service, in addition to the fee for
11 detention: Provided, however, That if the pilot bringing such
12 ship or vessel to the breakwater be there discharged, and the
13 ship or vessel afterward proceed to Philadelphia or any other
14 port or place on the bay or river Delaware, she shall make the
15 usual signal for a pilot and continue to make such signal till
16 reaching Brandywine Light, and if spoken by, or offered the
17 services of, a duly licensed Pennsylvania pilot before reaching
18 Brandywine Light, shall be obliged to employ such pilot and pay
19 him for services rendered on and after the effective date of
20 this act, a charge computed as follows:

22 (b) The charges per unit shall be as follows:

29 (iii) Effective January 1, 2015	$13.64 per unit

1 (c) There shall be a minimum charge of two hundred units and

11 Section 3.3. The following charges are hereby authorized for
12 the services stated:

13 (1) Ship communication charge:
14 Vessels transiting the Delaware River 15	[$220.00]  $235.00
16 (2) Transporting vessels in the Delaware:
17 Philadelphia (or other place) to Marcus Hook	750.00
18 Philadelphia (or other place) below Marcus Hook 19	750.00
20 Philadelphia Harbor to Torresdale	750.00
21 Philadelphia Harbor to any place above 22 Torresdale	1,000.00
23 (3) Extra services:
24 Swing ship to adjust magnetic compass	300.00
25 Swing ship to calibrate direction finder	300.00
26 Vessels anchoring below Brown Shoal in excess 27 of three hours awaiting flood tide for transiting 28 river channel	450.00
29 Carried to/from Baltimore	600.00
30 Carried to/from Norfolk	1,000.00

1 Carried to/from New York	1,000.00

2 Vessels entering the Capes for anchorage at the Breakwater for
3 other than tide shall pay one-half pilotage in and one-half
4 pilotage out.

5 (4) Chesapeake and Delaware Canal:
6 Vessels transiting the Chesapeake and Delaware 7 Canal:
8 Vessels with a length overall of less than 650 9 feet	1,000.00
10 Vessels with a length overall of 650 feet or 11 more	1,500.00
12 (5) Cancellation of sailing orders:
13 Cancellation charge	600.00

14 Any time a pilot is dispatched for sailing and the trip or
15 movement is canceled, for reason other than weather, the vessel
16 shall be subject to this charge, except when the Pilot Office is
17 notified as follows:

18 All piers north of Hog Island 19	-	1 1/2 hours before sailing time.
20 All piers north of Paulsboro	-	2 hours before sailing time.
21 All piers south of the above	-	3 hours before sailing time.

22 (6) Finance charge:

23 A finance charge not to exceed one and one-half per centum
24 per month or fraction thereof may be assessed against all
25 invoices outstanding more than thirty days after the billing
26 date, and the cost of attorney fees on any amount placed with an
27 attorney for collection may also be charged.

28 Section 2. This act shall take effect in 60 days.
