1Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2act relating to the public school system, including certain
3provisions applicable as well to private and parochial
4schools; amending, revising, consolidating and changing the
5laws relating thereto," providing for public hearing and vote
6on acquisition of automatic external defibrillators.

7The General Assembly of the Commonwealth of Pennsylvania
8hereby enacts as follows:

9Section 1. The act of March 10, 1949 (P.L.30, No.14), known
10as the Public School Code of 1949, is amended by adding a
11section to read:

12Section 1423.1. Public Hearing and Vote On Acquisition of
13Automatic External Defibrillators.--(a) Within ninety (90) days
14of the effective date of this section, the governing body of
15each school entity shall convene a public hearing to consider
16whether the school entity will acquire an automatic external
17defibrillator for each school building of the school entity.
18Representatives of the American Heart Association or the
19American Red Cross shall be invited to participate in the public
20hearing.

1(b) Within ninety (90) days of the public hearing convened
2pursuant to subsection (a), the governing body of each school
3entity shall approve or disapprove a resolution to acquire an
4automatic external defibrillator for each school building of the
5school entity by majority vote at a public meeting of the
6governing body.

7(c) Section 1423(c), (d), (e) and (f) shall apply to a
8school entity that acquires an automatic external defibrillator.

9(d) As used in this section--

10"Automatic external defibrillator" shall have the meaning set
11forth in section 1423(k).

12"School entity" means an area vocational-technical school, a
13charter school, a cyber charter school, an intermediate unit or
14a school district.

15Section 2. This act shall take effect immediately.
