AN ACT
1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, in penalties and disposition of fines, further
3providing for inability to pay fine and costs.
4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:
6Section 1. Section 6504 of Title 75 of the Pennsylvania
7Consolidated Statutes is amended to read:
8§ 6504. Inability to pay fine and costs.
9(a) Order for installment payments.--Upon plea and proof
10that a person is [unable] without the financial means to pay any
11fine and costs imposed under this title, a court may, in
12accordance with 42 Pa.C.S. § 9758 (relating to fine), order
13payment of the fine and costs in installments and shall fix the
14amounts, times and manner of payment.
15(b) Imprisonment for nonpayment.--Any person who does not
16comply with an order entered under this section may be
17imprisoned for a number of days equal to one day for each $40 of
18the unpaid balance of the fine and costs.
1(c) Community service.--Upon plea and proof that a person is
2without the financial means to pay any fine and costs imposed
3under this title, a court may, in accordance with 42 Pa.C.S. §
49730 (relating to payment of court costs, restitution and
5fines), order the performance of a reasonable period of
6community service. Court-ordered community service may be
7imposed under this subsection in lieu of payment of up to 50% of
8the fine and costs originally imposed. The court so ordering
9shall fix the duration, time and manner of the performance of
10community service.
11Section 2. This act shall take effect in 60 days.
