AN ACT

 

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, in enforcement, further providing for investigation
3by police officers.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 6308(b) of Title 75 of the Pennsylvania
7Consolidated Statutes is amended to read:

8§ 6308. Investigation by police officers.

10(b) Authority of police officer.--

11(1) Whenever a police officer is engaged in a systematic
12program of checking vehicles or drivers or has reasonable
13suspicion that a violation of this title is occurring or has
14occurred, he may stop a vehicle, upon request or signal, for
15the purpose of checking the vehicle's registration, proof of
16financial responsibility, vehicle identification number or
17engine number or the driver's license, or to secure such
18other information as the officer may reasonably believe to be

1necessary to enforce the provisions of this title.

2(2) Notwithstanding the provisions of paragraph (1), no
3police officer who stops a vehicle in accordance with
4paragraph (1) may use a data extraction device to secure
5information from an electronic device in the possession of
6the driver or passenger in the vehicle.

7(3) For purposes of this subsection, "data extraction
8device" means a tool used to extract data stored in a
9telecommunications device, including, but not limited to, the
10following data: call history, text messages, contacts,
11images, videos, geotags, voicemails, voice recordings, source
12messaging service (SMS) messages, multimedia messaging
13service (MMS) messages or subscriber identification module
14(SIM) data.

16Section 2. This act shall take effect in 60 days.
