1Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
2act to consolidate, editorially revise, and codify the public
3welfare laws of the Commonwealth," further providing for
4prohibited use of public assistance funds.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Section 484 of the act of June 13, 1967 (P.L.31,
8No.21), known as the Public Welfare Code, added December 17,
92009 (P.L.598, No.54), is amended to read:

10Section 484. Prohibited Use of Public Assistance Funds.--(a)
11It shall be unlawful for any individual to purchase tobacco, 
12tobacco paraphernalia, liquor or alcohol with [a gift
13certificate or a gift card which is in the form of] an
14electronic benefits transfer card issued to convey public
15assistance benefits administered by the [Department of Public

1Welfare] department or a debit card issued to convey support
2payment moneys. The department shall take appropriate measures 
3to prevent the use of public assistance funds for the purposes 
4proscribed in this section.

5(b) Assistance granted under this article shall not be
6withdrawn or used through a point of sale at any entity licensed
7by the Pennsylvania Gaming Control Board.

8Section 2. This act shall take effect in 60 days.
