AN ACT

 

1Amending the act of October 5, 1978 (P.L.1109, No.261), entitled
2"An act requiring the licensing of practitioners of
3osteopathic medicine and surgery; regulating their practice;
4providing for certain funds and penalties for violations and
5repeals," further providing for reasons for refusal,
6revocation or suspension of license.

7The General Assembly of the Commonwealth of Pennsylvania
8hereby enacts as follows:

9Section 1. Section 15(a)(3) of the act of October 5, 1978
10(P.L.1109, No.261), known as the Osteopathic Medical Practice
11Act, amended December 20, 1985 (P.L.398, No.108), is amended to
12read:

13Section 15. Reasons for refusal, revocation or suspension of
14license.

15(a) The board shall have authority to refuse, revoke or
16suspend the license of a physician for any of the following
17reasons:

19(3) Conviction of a felony, a crime involving moral

1turpitude, or a crime related to the practice of osteopathic
2medicine. Conviction shall include a finding or verdict of
3guilt, an admission of guilt or a plea of nolo contendere, or
4receiving probation without verdict, disposition in lieu of
5trial, or an Accelerated Rehabilitative Disposition in the
6disposition of felony charges. Notwithstanding any other 
7provision of this act, if a physician is convicted of an 
8offense under section 13(a)(12) of the act of April 14, 1972 
9(P.L.233, No.64), known as "The Controlled Substance, Drug, 
10Device and Cosmetic Act," or a substantially similar offense 
11in another state, the board shall permanently revoke the 
12license of the physician.

14Section 2. This act shall take effect in 60 days.
