AN ACT

 

1Amending the act of February 14, 2008 (P.L.6, No.3), entitled
2"An act providing for access to public information, for a
3designated open-records officer in each Commonwealth agency,
4local agency, judicial agency and legislative agency, for
5procedure, for appeal of agency determination, for judicial
6review and for the Office of Open Records; imposing
7penalties; providing for reporting by State-related
8institutions; requiring the posting of certain State contract
9information on the Internet; and making related repeals,"
10further providing for definitions and for regulations and
11policies.

12The General Assembly of the Commonwealth of Pennsylvania
13hereby enacts as follows:

14Section 1. Section 102 of the act of February 14, 2008
15(P.L.6, No.3), known as the Right-to-Know Law, is amended by
16adding a definition to read:

17Section 102. Definitions.

18The following words and phrases when used in this act shall
19have the meanings given to them in this section unless the
20context clearly indicates otherwise:

1"Employee benefits." Group life, health, hospitalization,
2medical service and accident insurance benefits, paid in whole
3or in part by an agency and offered generally to employees of
4the agency. The term includes payments made in lieu of the
5specified benefits.

7Section 2. Section 504 of the act is amended to read:

8Section 504. Regulations and policies.

9(a) Authority.--An agency may promulgate regulations and
10policies necessary for the agency to implement this act. The
11Office of Open Records may promulgate regulations relating to
12appeals involving a Commonwealth agency or local agency.

13(b) Posting.--The following information shall be posted at
14each agency and, if the agency maintains an Internet website, on
15the agency's Internet website:

16(1) Contact information for the open-records officer.

17(2) Contact information for the Office of Open Records
18or other applicable appeals officer.

19(3) A form which may be used to file a request.

20(4) Regulations, policies and procedures of the agency
21relating to this act.

22(c) Local agency posting.--

23(1) In addition to the information that is required to
24be posted under subsection (b), a local agency that maintains
25an Internet website shall post on its Internet website, for
26each employee of the agency:

27(i) The salary, wages or other compensation paid to
28the employee.

29(ii) The cost of providing the employee with
30employee benefits. Cost information shall be segregated

1by the type of employee benefit provided.

2(2) In the case of a local agency that does not maintain
3an Internet website, the agency shall, at least once each
4calendar year, publish the information enumerated in
5paragraph (1) in a newspaper of general circulation or a
6newsletter or other document disseminated to all households
7within the jurisdiction of the agency.

8Section 3. This act shall take effect in 60 days.
