AN ACT

 

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, providing for a Pennsylvania Monuments registration
3plate; and further providing for payments to special funds.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Title 75 of the Pennsylvania Consolidated
7Statutes is amended by adding a section to read:

8§ 1353.1. Pennsylvania Monuments registration plate.

9(a) Design.--The department shall design a Pennsylvania
10Monuments registration plate which shall have a replica of the
11Pennsylvania Memorial Monument at the Gettysburg National
12Military Park and shall display the words "Gettysburg 1863."

13(b) Application.--Upon application of any person,
14accompanied by a fee of $35 which shall be in addition to the
15annual registration fee, the department shall issue the
16registration plate under subsection (a) for a passenger car,
17motor home, trailer or truck with a registered gross weight of
18not more than 10,000 pounds.

1(c) Use of fee.--The Pennsylvania Monuments at Gettysburg
2National Military Park Trust Fund shall receive $15 of the fee
3paid by the applicant for the registration plate under
4subsection (a).

5Section 2. Section 1905 of Title 75 is amended by adding a
6subsection to read:

7§ 1905. Payments to special funds.

9(d) Pennsylvania Monuments at Gettysburg National Military
10Park Trust Fund.--The following shall apply:

11(1) There is established a special account in the State
12Treasury which shall be known as the Pennsylvania Monuments
13at Gettysburg National Military Park Trust Fund.

14(2) The Pennsylvania Monuments at Gettysburg National
15Military Park Trust Fund shall be funded from the following
16sources:

17(i) Proceeds paid to the department under section
181353.1(c) (relating to Pennsylvania Monuments
19registration plate) and contributions made under
20paragraph (3).

21(ii) Grants, gifts, donations and other payments
22from individuals, corporations, other trusts and
23foundations or other legal entities.

24(iii) Funds as may be appropriated to the
25Pennsylvania Monuments at Gettysburg National Military
26Park Trust Fund.

27(3) Beginning as soon as practicable, but not later than
28one year from the effective date of this subsection, the
29department shall provide an applicant for:

30(i) An original or renewal driver's license or

1identification card with an opportunity to make a
2contribution of $2 to the Pennsylvania Monuments at
3Gettysburg National Military Park Trust Fund. The
4contribution shall be added to the regular fee for an
5original or renewal driver's license or identification
6card. One contribution may be made for each issuance or
7renewal of a driver's license or identification card.

8(ii) A renewal vehicle registration with an
9opportunity to make a contribution of $2 to the
10Pennsylvania Monuments at Gettysburg National Military
11Park Trust Fund. The contribution shall be added to the
12regular fee for a renewal of a vehicle registration. One
13contribution may be made for each renewal vehicle
14registration.

15(4) All money in the Pennsylvania Monuments at
16Gettysburg National Military Park Trust Fund is annually
17appropriated to the Pennsylvania Historical and Museum
18Commission to provide grants to nonprofit organizations for
19the cleaning, repair and restoration of Pennsylvania
20monuments by the Gettysburg National Military Park. A grant
21under this paragraph may not be used to pay for the cost of
22cleaning, repair or restoration of the grounds surrounding a
23Pennsylvania monument.

24(5) The Auditor General may conduct audits and reviews
25of the Pennsylvania Historical and Museum Commission's use of
26grants under this section.

27(6) The Pennsylvania Historical and Museum Commission
28shall establish guidelines for awarding grants under
29paragraph (4) within 60 days of the effective date of this
30section. The guidelines shall be published as a notice in the

1Pennsylvania Bulletin and shall not be subject to any of the
2following:

3(i) Section 205 of the act of July 31, 1968
4(P.L.769, No.240), referred to as the Commonwealth
5Documents Law.

6(ii) Sections 204(b) and 301(10) of the act of
7October 15, 1980 (P.L.950, No.164), known as the
8Commonwealth Attorneys Act.

9(iii) The act of June 25, 1982 (P.L.633, No.181),
10known as the Regulatory Review Act.

11(7) Beginning before August 1, 2013, and before each
12August 1 thereafter, the commission shall submit a report to
13the majority and minority chairmen of the Veterans Affairs
14and Emergency Preparedness Committees of the Senate and the
15majority and minority chairmen of the Veterans Affairs and
16Emergency Preparedness Committees of the House of
17Representatives. The report shall detail the sources for and
18grants made from the Pennsylvania Monuments at Gettysburg
19National Military Park Trust Fund.

20Section 3. This act shall take effect in 60 days.
