AN ACT

 

1Amending Title 65 (Public Officers) of the Pennsylvania
2Consolidated Statutes, further providing for restricted
3activities.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 1103(f) of Title 65 of the Pennsylvania
7Consolidated Statutes is amended to read:

8§ 1103. Restricted activities.

10(f) Contract.--

11(1) No public official or public employee or his spouse
12or child or any business in which the person or his spouse or
13child is associated shall enter into any contract valued at
14$500 or more with the governmental body with which the public
15official or public employee is associated or any subcontract
16valued at $500 or more with any person who has been awarded a
17contract with the governmental body with which the public
18official or public employee is associated unless the contract

1has been awarded through an open and public process,
2including prior public notice and subsequent public
3disclosure of all proposals considered and contracts awarded.
4In such a case, the public official or public employee shall
5not have any supervisory or overall responsibility for the
6implementation or administration of the contract. Any
7contract or subcontract made in violation of this subsection
8shall be voidable by a court of competent jurisdiction if the
9suit is commenced within 90 days of the making of the
10contract or subcontract.

11(2) During a publicly elected Statewide officeholder's
12term of elected office and for a period of five years after
13leaving that office, the publicly elected Statewide
14officeholder may not enter into employment agreements, or
15contracts of any type, with a business or corporation that
16does business with the Commonwealth.

18Section 2. This act shall take effect in 60 days.
