AN ACT

 

1Amending Titles 42 (Judiciary and Judicial Procedure) and 53
2(Municipalities Generally) of the Pennsylvania Consolidated
3Statutes, in selection, retention and removal of judicial
4officers, further providing for content of course of
5instruction and examination; and, in municipal police
6education and training, further providing for powers and
7duties of the Municipal Police Officers' Education and
8Training Commission.

9The General Assembly of the Commonwealth of Pennsylvania
10hereby enacts as follows:

11Section 1. Section 3113(b) of Title 42 of the Pennsylvania
12Consolidated Statutes is amended to read:

13§ 3113. Content of course of instruction and examination.

15(b) Content of course.--The course of training and
16instruction shall not exceed four weeks in duration and shall
17consist of a minimum of 40 hours of class instruction in civil
18and criminal law, including evidence and procedure, summary
19proceedings, motor vehicles, the identification of child abuse 
20as defined in 23 Pa.C.S. Ch. 63 (relating to child protective 

1services), court proceedings involving children and courses in
2judicial ethics, in the case of all such officials except
3arraignment court magistrates, in which case the course of
4training shall consist of a minimum of 30 hours of class
5instruction in criminal law, search and seizure, arrest and bail
6practices and procedures, and except judges of the Traffic Court
7of Philadelphia, in which case the course of training shall
8consist of a minimum of 20 hours of class instruction in summary
9proceedings and laws relating to motor vehicles.

10Section 2. Section 2164 of Title 53 is amended by adding a
11paragraph to read:

12§ 2164. Powers and duties of commission.

13The powers and duties of the commission shall be as follows:

15(17) To train police officers with respect to:

16(i) Recognizing child abuse.

17(ii) Reporting child abuse under 23 Pa.C.S. Ch.63
18(relating to child protective services).

19(iii) The efficacy of conducting forensic
20interviewing of victims of child abuse within the setting
21of a children's advocacy center.

22As used in this paragraph, the terms "child abuse" and
23"children's advocacy center" shall have the meanings given in
2423 Pa.C.S. § 6303 (relating to definitions).

25Section 3. This act shall take effect in 60 days.
