1Amending Title 66 (Public Utilities) of the Pennsylvania
2Consolidated Statutes, in restructuring of electric utility
3industry, further providing for additional alternative energy
4sources.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1.  Section 2814(c) of Title 66 of the Pennsylvania
8Consolidated Statutes is amended to read:

9§ 2814.  Additional alternative energy sources.

11[(c)  Increase in Tier I.--The commission shall at least
12quarterly increase the percentage share of Tier I alternative
13energy sources required to be sold by an electric distribution
14company or electric generation supplier under section 3(b)(1) of
15the Alternative Energy Portfolio Standards Act to reflect any
16new biomass energy or low-impact hydropower resources that
17qualify as a Tier I alternative energy source under this
18section. No new resource qualifying as biomass energy or low-
19impact hydropower under this section shall be eligible to

1generate Tier I alternative energy credits until the commission
2has increased the percentage share of Tier I to reflect these
3additional resources.]

4Section 2.  This act shall take effect in 60 days.
