AN ACT

 

1Amending the act of February 14, 2008 (P.L.6, No.3), entitled
2"An act providing for access to public information, for a
3designated open-records officer in each Commonwealth agency,
4local agency, judicial agency and legislative agency, for
5procedure, for appeal of agency determination, for judicial
6review and for the Office of Open Records; imposing
7penalties; providing for reporting by State-related
8institutions; requiring the posting of certain State contract
9information on the Internet; and making related repeals," in
10procedure, further providing for exceptions for public
11records.

12The General Assembly of the Commonwealth of Pennsylvania
13hereby enacts as follows:

14Section 1.  Section 708(b)(6) of the act of February 14, 2008
15(P.L.6, No.3), known as the Right-to-Know Law, is amended to
16read:

19(b)  Exceptions.--Except as provided in subsections (c) and
20(d), the following are exempt from access by a requester under

1this act:

3(6)  (i)  The following personal identification
4information:

5(A)  A record containing all or part of a
6person's Social Security number, driver's license
7number, personal financial information, home,
8cellular or personal telephone numbers, personal e-
9mail addresses, employee number or other confidential
10personal identification number.

11(B)  A spouse's name, marital status or
12beneficiary or dependent information.

13(C)  The home address of a law enforcement
14officer or judge.

15(D)  The name and home address of a juror.

16(ii)  Nothing in this paragraph shall preclude the
17release of the name, position, salary, actual
18compensation or other payments or expenses, employment
19contract, employment-related contract or agreement and
20length of service of a public official or an agency
21employee.

22(iii)  An agency may redact the name or other
23identifying information relating to an individual
24performing an undercover or covert law enforcement
25activity from a record.

27Section 2.  This act shall take effect in 60 days.
