| AN ACT |
| |
1 | Providing for the highway capital budget project itemization for |
2 | flood-damaged highways to be financed from debt incurred |
3 | under clause (1) or (4) of subsection (a) of section 7 of | <-- |
4 | Article VIII of the Constitution of Pennsylvania. |
5 | The General Assembly of the Commonwealth of Pennsylvania |
6 | hereby enacts as follows: |
7 | Section 1. Short title. |
8 | This act shall be known and may be cited as the Capital |
9 | Budget Act of 2011 for Highways Damaged by Hurricane Irene and |
10 | Tropical Storm Lee. |
11 | Section 1.1. Definitions. | <-- |
12 | The following words and phrases when used in this act shall |
13 | have the meanings given to them in this section unless the |
14 | context clearly indicates otherwise: |
15 | "Capital project." A capital project as defined in section |
16 | 302 of the act of February 9, 1999 (P.L.1, No.1), known as the |
17 | Capital Facilities Debt Enabling Act, and shall include county |

1 | or municipal highway rehabilitation, replacement or improvement |
2 | projects as set forth in this chapter. |
3 | "Department." The Department of Transportation of the |
4 | Commonwealth. |
5 | "Secretary." The Secretary of Transportation of the |
6 | Commonwealth. |
7 | Section 2. Authorization. |
8 | The total authorization for the capital projects in the |
9 | category of highway projects itemized in sections 4 through 31 |
10 | and to be constructed by the Department of Transportation, its |
11 | successors or assigns, and to be financed from debt incurred |
12 | under clause (1) or (4) of subsection (a) of section 7 of | <-- |
13 | Article VIII of the Constitution of Pennsylvania, shall be |
14 | $75,000,000. |
15 | Section 3. Itemization of highway projects. |
16 | Additional capital projects in the category of public highway |
17 | projects to be constructed by the Department of Transportation, |
18 | its successors or assigns, and to be financed from debt incurred |
19 | under clause (1) of subsection (a) of section 7 of Article VIII |
20 | of the Constitution of Pennsylvania, are hereby itemized, |
21 | together with their respective estimated financial costs, in the |
22 | following sections. |

20 | Section 71. Estimated useful life of projects. |
21 | The General Assembly states the estimated useful life of the |
22 | projects heretofore itemized is 30 years. |
23 | Section 72. Federal funds. |
24 | All moneys received from the Federal Government for the |
25 | construction of the public highway projects specifically |
26 | itemized herein are also hereby appropriated for those projects. |
27 | Section 73. Construction. |
28 | Amounts contained in this act for any project shall not |
29 | supplant or replace any Federal funds authorized by any Federal |
30 | law or regulation. Funding from this act for any project is |
|
1 | available only to the extent that Federal funds are not |
2 | available for such project. |
3 | Section 74. Allocation of funds. |
4 | Whenever as determined by the Department of Transportation |
5 | that the full estimated financial costs of the projects itemized |
6 | in sections 4 through 31 are not necessary for the proper |
7 | design, acquisition or construction of such projects, the excess |
8 | funds no longer required may be allocated by the Department of |
9 | Transportation to increase the estimated costs of any one or |
10 | more of the projects specifically itemized in a capital budget. |
11 | Section 75. Effective date. |
12 | This act shall take effect immediately. |
