AN ACT

Providing for the highway capital budget project itemization for

2

flood-damaged highways to be financed from debt incurred

3

under clause (1) of subsection (a) of section 7 of Article

4

VIII of the Constitution of Pennsylvania.

The General Assembly of the Commonwealth of Pennsylvania

6

hereby enacts as follows:

Section 1.  Short title.

8

This act shall be known and may be cited as the Capital

9

Budget Act of 2011 for Highways Damaged by Hurricane Irene and

10

Tropical Storm Lee.

11

Section 2.  Authorization.

12

The total authorization for the capital projects in the

13

category of highway projects itemized in sections 4 through 31

14

and to be constructed by the Department of Transportation, its

15

successors or assigns, and to be financed from debt incurred

16

under clause (1) of subsection (a) of section 7 of Article VIII

17

of the Constitution of Pennsylvania, shall be $75,000,000.

Section 3.  Itemization of highway projects.

Additional capital projects in the category of public highway

3

projects to be constructed by the Department of Transportation,

4

its successors or assigns, and to be financed from debt incurred

5

under clause (1) of subsection (a) of section 7 of Article VIII

6

of the Constitution of Pennsylvania, are hereby itemized,

7

together with their respective estimated financial costs, in the

8

following sections.

Section 71.  Estimated useful life of projects.

The General Assembly states the estimated useful life of the

16

projects heretofore itemized is 30 years.

Section 72.  Federal funds.

18

All moneys received from the Federal Government for the

19

construction of the public highway projects specifically

20

itemized herein are also hereby appropriated for those projects.

21

Section 73.  Construction.

22

Amounts contained in this act for any project shall not

23

supplant or replace any Federal funds authorized by any Federal

24

law or regulation. Funding from this act for any project is

25

available only to the extent that Federal funds are not

26

available for such project.

Section 74.  Allocation of funds.

Whenever as determined by the Department of Transportation

29

that the full estimated financial costs of the projects itemized

30

in sections 4 through 31 are not necessary for the proper

design, acquisition or construction of such projects, the excess

2

funds no longer required may be allocated by the Department of

3

Transportation to increase the estimated costs of any one or

4

more of the projects specifically itemized in a capital budget.

Section 75.  Effective date.

6

This act shall take effect immediately.
