| AN ACT |
| |
1 | Amending the act of June 30, 1981 (P.L.128, No.43), entitled "An |
2 | act authorizing the creation of agricultural areas," further |
3 | providing for the purchase of agricultural conservation |
4 | easements. |
5 | The General Assembly of the Commonwealth of Pennsylvania |
6 | hereby enacts as follows: |
7 | Section 1. Section 14.1(i)(1) of the act of June 30, 1981 |
8 | (P.L.128, No.43), known as the Agricultural Area Security Law, |
9 | amended November 23, 1994 (P.L.621, No.96), is amended to read: |
10 | Section 14.1. Purchase of agricultural conservation easements. |

12 | (i) Subdivision of land after easement purchase.-- |
13 | (1) Each county program shall specify the conditions |
14 | under which the subdivision of land subject to an |
15 | agricultural conservation easement may be permitted. In no |
16 | case, however, shall a county program permit a subdivision |
17 | which will: |
18 | (i) harm the economic viability of the farmland for |
19 | agricultural production; or |

1 | (ii) convert land which has been devoted primarily |
2 | to agricultural use to another primary use, except that a |
3 | county program may permit one subdivision [for the |
4 | purpose of the construction of a principal residence for |
5 | the landowner or an immediate family member.], provided |
6 | that the tract of land so subdivided may not exceed two |
7 | acres and may only be used for residential purposes or |
8 | for agricultural or forest reserve as defined under |
9 | section 2 of the act of December 19, 1974 (P.L.973, |
10 | No.319), known as the "Pennsylvania Farmland and Forest |
11 | Land Assessment Act of 1974." |

13 | Section 2. This act shall take effect in 60 days. |
