| AN ACT |
| |
1 | Amending Title 18 (Crimes and Offenses) of the Pennsylvania |
2 | Consolidated Statutes, prohibiting the illegal use of laser |
3 | pointer. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Title 18 of the Pennsylvania Consolidated |
7 | Statutes is amended by adding a section to read: |
8 | § 5518. Use of laser pointer. |
9 | (a) Offense defined.--A person commits an offense if that |
10 | person knowingly, with the intent to harass, annoy or alarm, |
11 | shines a laser pointer at another person. |
12 | (b) Grading.-- |
13 | (1) Except as provided in paragraph (2), an offense |
14 | under subsection (a) is a summary offense. |
15 | (2) If the offense in subsection (a) is committed |
16 | against a person operating a motor vehicle, the offense shall |
17 | be a misdemeanor of the third degree. |
18 | (c) Definition.--As used in this section, the term "laser |

1 | pointer" means a handheld device that emits a laser beam. |
2 | Section 2. This act shall take effect in 60 days. |
