| AN ACT |
| |
1 | Amending Title 42 (Judiciary and Judicial Procedure) of the |
2 | Pennsylvania Consolidated Statutes, in officers serving |
3 | process and enforcing orders, providing for municipal police. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Chapter 29 of Title 42 of the Pennsylvania |
7 | Consolidated Statutes is amended by adding a subchapter to read: |
8 | SUBCHAPTER D |
9 | MUNICIPAL POLICE |
10 | Sec. |
11 | 2961. Municipal police. |
12 | § 2961. Municipal police. |
13 | (a) Fee.--If a municipal police officer executes one or more |
14 | warrants or effectuates the payment of fines and costs by |
15 | attempting to execute one or more warrants, the fee for such |
16 | service shall be $35 per defendant. |
17 | (b) Payment.--The fee shall be borne by the defendant. The |
18 | fee shall be collected as provided by law for court costs. Once |

1 | collected, the fee shall be remitted to the municipality which |
2 | provided the service or to the Commonwealth if no municipal |
3 | police department exists for the municipality. |
4 | (c) Definition.--As used in this section, the term |
5 | "municipal police officer" shall include the Pennsylvania State |
6 | Police where no municipal police department exists. |
7 | Section 2. This act shall take effect in 60 days. |
