| A RESOLUTION |
| |
1 | Memorializing Congress to repeal the provisions of the Energy |
2 | Independence and Security Act of 2007, which creates Federal |
3 | energy efficiency standards for lighting. |
4 | WHEREAS, The Energy Independence and Security Act of 2007 |
5 | effectively bans the sale of most current incandescent light |
6 | bulbs beginning January 2012; and |
7 | WHEREAS, Existing alternatives, including the most common |
8 | replacement, compact fluorescent light bulbs (CFLs), to |
9 | incandescent light bulbs are often more expensive than their |
10 | standard incandescent counterparts; and |
11 | WHEREAS, CFLs are loaded with toxic mercury, which upon |
12 | breakage or disposal pollutes the environment via seepage into |
13 | groundwater and rivers and lakes and threatens human health; and |
14 | WHEREAS, Such a change would jeopardize the economic |
15 | stability and well-being of many American manufacturers who have |
16 | been producing incandescent light bulbs for decades; and |

1 | WHEREAS, The unnecessary limitation of available light bulb |
2 | selection would obstruct free choice of American consumers by |
3 | depriving them of long-established personal liberties; and |
4 | WHEREAS, The Tenth Amendment to the Constitution of the |
5 | United States reserves to the states and their people all powers |
6 | not delegated to the Federal Government and not prohibited to |
7 | the states; and |
8 | WHEREAS, The Ninth Amendment to the Constitution of the |
9 | United States provides that certain rights enumerated in the |
10 | Constitution shall not be construed to deny or disparage other |
11 | rights retained by the people; and |
12 | WHEREAS, It is therefore evident that if an item manufactured |
13 | in this Commonwealth without the inclusion of any significant |
14 | parts imported from another state and offered for sale and sold |
15 | only for use within the borders of this Commonwealth, the item |
16 | is not in the stream of interstate commerce and not subject to |
17 | Federal regulation under the Commerce Clause of the Constitution |
18 | of the United States pursuant to section 8 of Article I; |
19 | therefore be it |
20 | RESOLVED, That the House of Representatives of the |
21 | Commonwealth of Pennsylvania memorialize members of each house |
22 | of Congress to repeal the provisions of the Energy Independence |
23 | and Security Act of 2007, which creates Federal energy |
24 | efficiency standards for lighting; and be it further |
25 | RESOLVED, That copies of this resolution be transmitted to |
26 | the presiding officers of each house of Congress and to each |
27 | member of Congress from Pennsylvania. |
