AN ACT

Amending Title 35 (Health and Safety) of the Pennsylvania

2

Consolidated Statutes, authorizing the Pennsylvania Emergency

3

Management Agency to pay rewards for information leading to

4

the arrest and conviction of certain perpetrators; and

5

establishing the Law Enforcement Line of Duty Death Reward

6

Fund.

The General Assembly of the Commonwealth of Pennsylvania

8

hereby enacts as follows:

Section 1.  Chapter 73 of Title 35 of the Pennsylvania

10

Consolidated Statutes is amended by adding a subchapter to read:

§ 7391.  Scope of subchapter.

This subchapter authorizes the agency to offer and cause to

be paid rewards for the arrest and conviction of perpetrators of

2

an offense under 18 Pa.C.S. § 2507 (relating to criminal

3

homicide of law enforcement officer) and establishes a fund from

4

which to make reward payments.

§ 7392.  Definitions.

6

The following words and phrases when used in this subchapter

7

shall have the meanings given to them in this section unless the

8

context clearly indicates otherwise:

"Fund."  The Law Enforcement Line of Duty Death Reward Fund

10

established in section 7394 (relating to Law Enforcement Line of

11

Duty Death Reward Fund).

12

"Law enforcement officer."  The term has the same meaning as

13

the term "peace officer" as set forth in 18 Pa.C.S. § 501

14

(relating to definitions).

§ 7393.  Agency authority.

16

The agency is authorized to offer and cause to be paid

17

rewards of up to $50,000 for information leading to the arrest

18

and conviction of perpetrators of an offense under 18 Pa.C.S. §

19

2507 (relating to criminal homicide of law enforcement officer).

§ 7394.  Law Enforcement Line of Duty Death Reward Fund.

(a)  Establishment of fund.--The Law Enforcement Line of Duty

22

Death Reward Fund is established as a special fund in the State

23

Treasury.

24

(b)  Administration.--The fund shall be administered by the

25

agency. The agency shall use moneys in the fund solely for the

26

purpose of section 7393 (relating to agency authority).

27

(c)  Fund sources.--The sources of the fund are as follows:

28

(1)  Moneys transferred under subsection (d).

29

(2)  Contributions and donations to the fund.

(d)  Transfers.--Commencing with fiscal year 2012-2013 and

continuing annually thereafter, the sum of $750,000 shall be

2

transferred from the State Gaming Fund to the Law Enforcement

3

Line of Duty Death Reward Fund.

Section 2.  This act shall take effect in 60 days.
