AN ACT

Amending Title 75 (Vehicles) of the Pennsylvania Consolidated

2

Statutes, in inspection of vehicles, further providing for

3

inspection by police or Commonwealth personnel; in

4

enforcement, further providing for investigation by police

5

officers.

The General Assembly of the Commonwealth of Pennsylvania

7

hereby enacts as follows:

Section 1.  Sections 4704(a)(2) and 6308(b) of Title 75 of

9

the Pennsylvania Consolidated Statutes are amended to read:

§ 4704.  Inspection by police or Commonwealth personnel.

(a)  Authority to inspect.--

12

(2)  Systematic vehicle inspection programs.--Any

14

Pennsylvania State Police officer or qualified Commonwealth

15

employee engaged in a systematic vehicle inspection program

16

may inspect any vehicle, driver, documents, equipment and

17

load to determine whether they meet standards established in

18

department regulations. No Commonwealth agency or political

19

subdivision shall accept Federal funds to establish a

systematic vehicle inspection program based on stopping only

2

a particular type of vehicle, such as a passenger car, truck

3

or motorcycle. Notwithstanding this subsection, Federal

4

funding may be accepted if a program stops only commercial

5

motor vehicles, as defined in section 1603 (relating to

6

definitions).

§ 6308.  Investigation by police officers.

(b)  Authority of police officer.--Whenever a police officer

11

is engaged in a systematic program of checking vehicles or

12

drivers or has reasonable suspicion that a violation of this

13

title is occurring or has occurred, he may stop a vehicle, upon

14

request or signal, for the purpose of checking the vehicle's

15

registration, proof of financial responsibility, vehicle

16

identification number or engine number or the driver's license,

17

or to secure such other information as the officer may

18

reasonably believe to be necessary to enforce the provisions of

19

this title. No Commonwealth agency or political subdivision

20

shall accept Federal funds to establish a systematic program of

21

checking vehicles or drivers based on stopping only a particular

22

type of vehicle, such as a passenger car, truck or motorcycle.

23

Notwithstanding this subsection, Federal funding may be accepted

24

if a program stops only commercial motor vehicles, as defined in

25

section 1603 (relating to definitions).

Section 2.  This act shall take effect in 60 days.
