| AN ACT |
| |
1 | Amending Title 25 (Elections) of the Pennsylvania Consolidated |
2 | Statutes, further providing for methods of voter |
3 | registration; providing for electronic voter registration |
4 | application; and further providing for preparation and |
5 | distribution of applications. |
6 | The General Assembly of the Commonwealth of Pennsylvania |
7 | hereby enacts as follows: |
8 | Section 1. Section 1321 of Title 25 of the Pennsylvania |
9 | Consolidated Statutes is amended by adding a paragraph to read: |
10 | § 1321. Methods of voter registration. |
11 | An individual qualified to register to vote under section |
12 | 1301(a) (relating to qualifications to register) may apply to |
13 | register as follows: |

15 | (5) Under section 1325.1 (relating to electronic voter |
16 | registration application). |
17 | Section 2. Title 25 is amended by adding a section to read: |

1 | § 1325.1. Electronic voter registration application. |
2 | An electronic voter registration application shall be |
3 | established and implemented by the department within 90 days of |
4 | the effective date of this section. The secretary shall |
5 | promulgate regulations necessary to establish, implement and |
6 | administer the electronic voter registration application. |
7 | Section 3. Section 1327(a)(4) of Title 25 is amended to |
8 | read: |
9 | § 1327. Preparation and distribution of applications. |
10 | (a) Form.-- |
11 | * * * |
12 | (4) A voter registration application, except a |
13 | registration application under section 1325.1 (relating to |
14 | electronic voter registration application), shall be printed |
15 | on stock of good quality and shall be of suitable uniform |
16 | size. [Nothing in this part shall prohibit the design and use |
17 | of an electronic voter registration application which |
18 | includes the applicant's digitized or electronic signature.] |
19 | The registration application shall contain the following |
20 | information; however, the information may be provided on a |
21 | separate form for voter registration made under section 1323 |
22 | or 1325: |
23 | (i) Notice that a registered elector does not need |
24 | to reregister unless the registered elector has moved. |
25 | (ii) Instructions on how to fill out and submit the |
26 | application and notification of when the application must |
27 | be submitted to a voter registration office in order to |
28 | be registered for the ensuing election. |
29 | (iii) Notice that the applicant must be a citizen of |
30 | the United States for at least one month prior to the |

1 | next election and a resident of this Commonwealth and the |
2 | election district for at least 30 days and must be at |
3 | least 18 years of age by the day of the next ensuing |
4 | election and has not been confined in a penal institution |
5 | for a conviction of a felony within the last five years. |
6 | The notice required in this subparagraph shall be in |
7 | print identical to the declaration under subsection (b). |
8 | (iv) Notice that political party enrollment is |
9 | mandatory to vote in a primary election of a political |
10 | party. |
11 | (v) Notice that the commission will mail by |
12 | nonforwardable mail to the applicant a voter's |
13 | identification card upon acceptance of the application |
14 | and that the applicant should contact the commission if |
15 | the identification card is not received within 14 days |
16 | from the date the application is sent to the registration |
17 | office. |
18 | (vi) Notice that registration is not complete until |
19 | the application is processed and accepted by the |
20 | commission. |
21 | (vii) A warning to the applicant that making a false |
22 | registration or furnishing false information is perjury. |
23 | The notice required in this subparagraph shall be in |
24 | print identical to the declaration under subsection (b). |
25 | (viii) Instructions to Federal or State employees |
26 | who wish to retain voting residence in county of last |
27 | residence to so indicate on the application. |
28 | (ix) Notice that, if an individual declines to |
29 | register to vote, the fact that the individual has |
30 | declined to register will remain confidential and will be |

1 | used only for voter registration purposes. The notice |
2 | required in this subparagraph shall be in print identical |
3 | to the declaration under subsection (b). |
4 | (x) Notice that, if an individual does register to |
5 | vote, the office at which the individual submits a voter |
6 | registration application will remain confidential and |
7 | will be used for voter registration purposes only. The |
8 | notices required in this subparagraph shall be in print |
9 | identical to the declaration in subsection (b). |

11 | Section 4. This act shall take effect immediately. |
