AN ACT

Amending the act of August 15, 1961 (P.L.987, No.442), entitled

2

"An act relating to public works contracts; providing for

3

prevailing wages; imposing duties upon the Secretary of Labor

4

and Industry; providing remedies, penalties and repealing

5

existing laws," further providing for the definition of

6

"public work."

The General Assembly of the Commonwealth of Pennsylvania

8

hereby enacts as follows:

Section 1.  Section 2(5) of the act of August 15, 1961

10

(P.L.987, No.442), known as the Pennsylvania Prevailing Wage

11

Act, amended August 9, 1963 (P.L.653, No.342), is amended to

12

read:

Section 2.  Definitions.--As used in this act--

14

(5)  "Public work" means construction, reconstruction,

16

demolition, alteration and/or repair work other than maintenance

17

work, done under contract and paid for in whole or in part out

18

of the funds of a public body where the estimated cost of the

total project is in excess of twenty-five thousand dollars

2

($25,000), but shall not include work performed under a

3

rehabilitation or manpower training program, work performed on a

4

project by or on behalf of a health care facility as defined in

5

section 103 of the act of July 19, 1979 (P.L.130, No.48), known

6

as the Health Care Facilities Act, or work performed on a

7

project by or on behalf of an entity subject to Article IX or X  

8

of the act of June 13, 1967 (P.L.31, No.21), known as the Public

9

Welfare Code.

Section 2.  This act shall take effect in 60 days.
