AN ACT

Amending the act of February 14, 2008 (P.L.6, No.3), entitled

2

"An act providing for access to public information, for a

3

designated open-records officer in each Commonwealth agency,

4

local agency, judicial agency and legislative agency, for

5

procedure, for appeal of agency determination, for judicial

6

review and for the Office of Open Records; imposing

7

penalties; providing for reporting by State-related

8

institutions; requiring the posting of certain State contract

9

information on the Internet; and making related repeals," in

10

preliminary provisions, further providing for definitions;

11

and, in access, further providing for regulations and

12

policies.

The General Assembly of the Commonwealth of Pennsylvania

14

hereby enacts as follows:

15

Section 1.  Section 102 of the act of February 14, 2008

16

(P.L.6, No.3), known as the Right-to-Know Law, is amended by

17

adding a definition to read:

The following words and phrases when used in this act shall

20

have the meanings given to them in this section unless the

21

context clearly indicates otherwise:

"Employee benefits."  Group life, health, hospitalization,

3

medical service and accident insurance plans or benefits, or

4

payments made in lieu of such benefits, paid in whole or in part

5

by an agency and offered generally to employees of the agency.

Section 2.  Section 504 of the act is amended by adding a

8

subsection to read:

(c)  Local agency posting.--

12

(1)  In addition to the information that is required to

13

be posted under subsection (b), a local agency that maintains

14

an Internet website shall post on its Internet website, for

15

each employee of the agency:

16

(i)  The salary, wages or other compensation paid to

17

the employee.

18

(ii)  The cost of providing the employee with

19

employee benefits. Cost information shall be segregated

20

by the type of employee benefit provided.

21

(2)  In the case of a local agency that does not maintain

22

an Internet website, the agency shall, at least once each

23

calendar year, publish the information enumerated in

24

paragraph (1) in a newspaper of general circulation or a

25

newsletter or other document disseminated to all households

26

within the jurisdiction of the agency.

Section 3.  This act shall take effect in 60 days.
