| AN ACT |
| |
1 | Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An |
2 | act relating to the public school system, including certain |
3 | provisions applicable as well to private and parochial |
4 | schools; amending, revising, consolidating and changing the |
5 | laws relating thereto," in district superintendents and |
6 | assistant district superintendents, providing for severance |
7 | packages. |
8 | The General Assembly of the Commonwealth of Pennsylvania |
9 | hereby enacts as follows: |
10 | Section 1. The act of March 10, 1949 (P.L.30, No.14), known |
11 | as the Public School Code of 1949, is amended by adding a |
12 | section to read: |
13 | Section 1075.1. Severance Packages.--(a) If a board of |
14 | school directors: |
15 | (1) enters into a contract with a district superintendent or |
16 | assistant district superintendent, as provided by this article, |
17 | after the effective date of this section; |
18 | (2) terminates the contract; and |
19 | (3) upon termination, pays to the district superintendent or |

1 | assistant district superintendent an amount greater than twenty- |
2 | five thousand dollars ($25,000) for all compensation, |
3 | the school entity shall be subject to a fine pursuant to |
4 | subsection (b). |
5 | (b) The Department of Education shall fine a school district |
6 | which violated subsection (a) an amount equal to the market |
7 | value to income aid ratio of the school district multiplied by |
8 | the amount of compensation in excess of twenty-five thousand |
9 | dollars ($25,000). |
10 | (c) For the purposes of this section, "compensation" shall |
11 | include all payments for salary for the remaining term of a |
12 | contract, payment for unused sick leave and vacation days, |
13 | payment of health insurance benefits and any other payment made |
14 | to or on behalf of a district superintendent or assistant |
15 | district superintendent upon termination as specified by the |
16 | contract. |
17 | Section 2. This act shall take effect in 90 days. |
