AN ACT

Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An

2

act relating to the public school system, including certain

3

provisions applicable as well to private and parochial

4

schools; amending, revising, consolidating and changing the

5

laws relating thereto," in district superintendents and

6

assistant district superintendents, providing for severance

7

packages.

The General Assembly of the Commonwealth of Pennsylvania

9

hereby enacts as follows:

Section 1.  The act of March 10, 1949 (P.L.30, No.14), known

11

as the Public School Code of 1949, is amended by adding a

12

section to read:

Section 1075.1.  Severance Packages.--(a)  If a board of

14

school directors:

15

(1)  enters into a contract with a district superintendent or

16

assistant district superintendent, as provided by this article,

17

after the effective date of this section;

18

(2)  terminates the contract; and

19

(3)  upon termination, pays to the district superintendent or

assistant district superintendent an amount greater than twenty-

2

five thousand dollars ($25,000) for all compensation,

3

the school entity shall be subject to a fine pursuant to

4

subsection (b).

(b)  The Department of Education shall fine a school district

6

which violated subsection (a) an amount equal to the market

7

value to income aid ratio of the school district multiplied by

8

the amount of compensation in excess of twenty-five thousand

9

dollars ($25,000).

(c)  For the purposes of this section, "compensation" shall

11

include all payments for salary for the remaining term of a

12

contract, payment for unused sick leave and vacation days,

13

payment of health insurance benefits and any other payment made

14

to or on behalf of a district superintendent or assistant

15

district superintendent upon termination as specified by the

16

contract.

Section 2.  This act shall take effect in 90 days.
